A federal judge today granted Pfizer Inc.’s (NYSE: PFE) motion to dismiss the state court complaint filed against it following a complaint by its customers.
The complaint alleges that Pfizer, Inc. and its subsidiary, Mylan Pharmaceuticals Inc., were engaged in “doctor shopping” and “selling unapproved prescription drugs.”
The complaint, which was filed in state court in San Francisco, alleges that Mylan acquired a “traded-off” patent on Viagra (sildenafil citrate), an erectile dysfunction medicine, and sold it for a total of $8.3 million.
The FDA has approved Viagra and its generic equivalent, sildenafil citrate, for use in treating erectile dysfunction. The FDA will soon decide whether Pfizer’s drug was “approved” for sale, and whether the FDA has any concerns about the use of the drug in San Francisco.
Mylan’s complaint alleged that Mylan acquired a “traded-off” patent on Viagra (sildenafil citrate), an erectile dysfunction medicine, and sold it for a total of $8.3 million.
The complaint alleged that Pfizer marketed Viagra in violation of section 505 of the Health and Human Services Act. Section 505 of the Act requires that such “complaints be filed only within the 180-day period for filing a lawsuit.” The complaint states that Pfizer “has not submitted a proposed amendment to the Pfizer-Mylan Agreement or filed a proposed amendment to the Pfizer-Mylan Agreement.”
Pfizer has filed no amendment to the Pfizer-Mylan Agreement or filed a proposed amendment to the Pfizer-Mylan Agreement. It has agreed to settle all future civil proceedings, including the complaint and all other claims.
Under California law, if a defendant has made a civil violation of the civil laws of the state, it may be liable to the defendant for any damages sustained as a result of the violation.
The complaint states that Pfizer has failed to adequately state a claim for breach of warranty and that the FDA’s “unreasonably dangerous” manufacturing and sale of Viagra and other generic drugs was “breach of contract” in connection with its “drug sales”.
A jury awarded Pfizer $6.5 million, $2.5 million in compensatory damages, and $1.5 million in punitive damages.
The complaint was filed on March 28, 2013, and was not part of the record.

It is being filed in the United States District Court for the District of San Diego. The California Superior Court of the State of California has appointed a special Master on April 7, 2013.
